Nigerian Court Stops Ondo Government From Forcefully Evicting Over 10,000 Farmers From Forest Reserve

Ondo State High Court, Ore Judicial division, sitting at Ondo, coram Hon. Justice Ademola Adegoroye just granted an order of injunction , restraining the Ondo state government and others, including the private company SAO AGRO-ALLIED SERVICES LIMITED, accused of bringing buldozers to the land to destroy the farmers cocoa plantations from grading the farmers’ cocoa farms or forcefully ejecting them from Oluwa Forest Reserve in Ondo state.

In the application filed for the farmers by their counsel, Tope Temokun, the farmers prayed the court for the following reliefs:

AN ORDER OF INTERIM INJUNCTION restraining the Defendants/Respondents and their privies and their servants and their agents and/or anyone acting through them or for them or on their instruction or authority, from further grading or continuing to grade the claimants/applicants’ farmlands of cocoa plantations in their farmlands covering the camps of Temidire, Adeleye Itamerin, Ikawo, Ijoba, Ayeleso, Isero and their sub-camps, within Oluwa Forest Reserve (OA3A) Odigbo, Odigbo Local Government Area of Ondo State), subject-matter of this suit, pending the hearing of the motion on notice for interlocutory injunction;
  2. AN ORDER OF INTERIM INJUNCTION restraining the Defendants/Respondents and their privies and their servants and their agents and/or anyone acting through them or for them or on their instruction or authority, from forcefully evicting the Claimants/Applicants from their farmlands of grown cocoa plantations, covering the camps of Temidire, Adeleye Itamerin, Ikawo, Ijoba, Ayeleso, Isero and their sub-camps, within Oluwa Forest Reserve (OA3A) Odigbo, Odigbo Local Government Area of Ondo State), subject-matter of this suit, or from taking over the Claimants/Applicants’ said farmlands, pending the hearing of the motion on notice for interlocutory injunction.

The court after hearing Tope Temokun for the over ten thousand farmers, men.and women, young and old, who stormed the court premises in their thousands, ruled that the application has merit and deserving of being granted and ordered as prayed
